In Ireland, planning permission is not required for installing modular buildings (including

capsule homes) if the structure qualifies as an Exempted Development under the

guidelines of PL5 — Works around the house.

Capsule Homes meet these requirements — provided certain conditions, listed below, are

observed.

1. Maximum Permitted Size

You can install a modular unit of up to 25 m² on your property without planning permission,

as long as:

at least 25 m² of open space remains unbuilt in your rear and/or side garden after

installation;

the allowed limit.

the capsule is not attached to other extensions or structures that would, in total, exceed

If your property already includes structures like a garage or utility shed, their combined size

may count toward the overall limit. However, if those structures were part of the original

approved planning for your main home, you may still be allowed to add up to 25 m²

additionally.

2. Window Placement

All windows or glazed elements that face a neighbour’s property must be installed at least 1

metre away from the boundary with that property.3. Height Restrictions

The maximum height is 3 metres, applicable to flat or mono-pitched roofs.

All Capsule Homes are designed to stay within this limit, including the base and roof

structure.

4. Permitted Uses of the Capsule

A capsule unit may be used as:

a home office

a guest room

a creative studio or workshop

a leisure or rental space

temporary accommodation (without registering it as your primary residence)

⚠ Permanent residential use or registering the capsule as your main dwelling requires

consultation with your local planning authority.

5. Location on Your Property

The capsule can be placed to the rear or side of your main house.

If placed on the side, one of the following must apply:

it should be screened from the street by fencing, trees, or shrubs,

or the façade must visually match the architectural style of the main house.

6. Do I Need to Notify My Neighbours?

Legally, you are not required to notify your neighbours when installing a modular unit under

exempted development.

However, we always recommend friendly communication with your closest neighbours to

maintain good relations.7. Who Is Responsible for Compliance?

The property owner is responsible for ensuring the capsule complies with exempted

development rules.
